1. What Porch Pay is

Porch Pay is an app for viewing your loan, making payments, exchanging messages with the company servicing your loan (your "Servicer"), and accessing your documents. Porch Pay is software. Porch Pay is not your lender and does not own your loan. Your loan is governed entirely by the contract you signed with your Servicer — your land contract, contract for deed, trust agreement, or similar document. If anything in the app conflicts with that contract, the contract controls.

2. Your account

Your Servicer creates your account and gives you a temporary password. You must set your own password when you first sign in. Keep it confidential — you are responsible for activity under your account. Tell your Servicer right away if you believe someone else has access. Your account shows only your own loan.

4. Electronic communications and notices

By accepting these terms you consent to receive communications and notices about your loan electronically through the app, including account messages, payment reminders, late notices, and other notices about your loan. The app records when a notice is sent and when you open it.

Electronic notice does not replace notice required by law. Where your contract or applicable law requires a notice to be delivered by mail, personal service, or another specific method, your Servicer must still deliver it that way. You may withdraw consent to electronic communications by contacting your Servicer, though doing so may mean you can no longer use the app.

5. Acceptable use

Do not use Porch Pay to break the law, attempt to access another person's account or another company's data, interfere with the app's operation, or upload malicious files. We may suspend accounts that do.

6. Documents

Documents your Servicer shares with you are provided for your reference. Keep your own copies of anything important. Availability of a document in the app is not a guarantee of its accuracy or completeness.

7. Deleting your account

You may delete your account at any time in the app under Settings → Delete account, or at porchpay/delete-account. Deleting your app account does not cancel your loan, erase what you owe, or end your obligations under your contract. Your Servicer retains loan records as required by law.

8. Availability and disclaimers

We work to keep Porch Pay available, but we do not guarantee uninterrupted or error-free service. The app is provided "as is" without warranties of any kind to the fullest extent permitted by law. If the app is unavailable when a payment is due, you remain responsible for paying by another method your Servicer accepts.

9. Limitation of liability

To the fullest extent permitted by law, Porch Pay and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from your use of the app. Nothing here limits liability that cannot be limited by law, and nothing here limits your rights against your Servicer under your loan contract or under consumer protection law.

10. Changes

We may update these terms. If we make material changes we will update the version above and ask you to accept the new version the next time you open the app.
